The Terms & Condition herein are termed as an “Agreement” between TCPL and the user / visitor / member / subscriber. The major purpose and objective of dialurban is to serve as a preliminary medium of contact for exchange of information for its users / members / visitors who have a bonafide intention to contact and/or be contacted for the purposes related to genuine domestic and professional services and for other related services / information.

This website www.dialurban.com, including any sub-domains, and any other websites through which its services are made available like our mobile, tablet and other smart device applications, and application program interfaces etc, (hereinafter collectively referred to as "dialurban or dialurban") is owned, hosted, operated and managed by Triptales Commercials Pvt. Ltd. (hereinafter referred to as TCPL), a company incorporated in India under the Companies Act, 1956 and having its registered office at Bhubaneswar, Odisha. These terms and conditions, privacy policy and guidelines regulating the use of these Services constitute a legally binding agreement between dialurban and the User (the “Agreement”).

By accessing or using “dialurban”, you agree to be bound by the Privacy Policy and Terms & Conditions set forth in the website. By using this platform you indicate your understanding and acceptance of these terms.

In the event of non-compliance with this terms & condition, dialurban has the right to limit or terminate your access or usage rights to the platform immediately or remove non-compliant information or both as the case may be, in accordance with the information technology (intermediary guidelines and digital media ethics code) rules, 2021. TCPL may amend/modify any of these points in the privacy policy and terms & conditions at any time, and such modifications shall be effective immediately upon posting of the modified privacy policy and terms & conditions on dialurban. You should review the amendments related to privacy policy and terms & conditions periodically to be aware of such modifications and your continued access or use of dialurban, shall be deemed as a conclusive proof of your acceptance of these modified privacy policy and terms & conditions, as amended / modified from time to time. TCPL shall suspend the operation of dialurban for support or technical up gradation, maintenance work, in order to update the content or for any other reason. If you use dialurban in a manner inconsistent with these privacy policy and terms & conditions, then TCPL may terminate your access, block your future access.
Terms of Reference –
The terms and conditions / T&C / Terms of Use set forth and the Privacy Policy constitute a legally-binding agreement between dialurban or Triptales Commercials Pvt Ltd (Referred as the “Company” or “TCPL”) and You (Referred as the manufacturer/supplier/user/viewer/member/customer). These T&C contain clauses that define your limits, legal rights and obligations with respect to:

Your use of and participation in all the dialurban services, dialurban website and mobile application, including the classifieds, all kind of advertisements, postings, Listings, Products available through the platform of dialurban at www.Dialurban.com (collectively referred to herein as the "Website" or “Dialurban” of “Dialurban”)
The online transactions between those manufacturer/supplier/user/viewer/member/customer of the Website who are offering services (referred as “Service”) and those users of the Website who are obtaining services through the website (referred as "User"). The T&C described below apply to all users/viewers/members of the Website.

The Website serves as a B2B & B2C platform for the online distribution and publication of user submitted information between Service/Product Professionals/Manufacturer/Supplier and Service/Product Users/Buyer; by using, visiting, registering for, and/or otherwise participating in this Website, and by clicking on "I have read and agree to the Terms & Conditions," or by subscribing to or interacting with other User(s) on or entering into negotiations in respect of sale or supply of goods or services on or using the Web Site in any manner for any purpose, You undertake and agree that You have fully read, understood and accepted the Agreement, and you hereby certify that:

You are either a Service/Product Professional, or a Manufacturer, or a Supplier, or a prospective Service/Product User or Buyer,
You authorize dialurban the transfer of payment for Services/Product requested through the use of the Website, and
You agree to be bound by all terms and conditions and any other documents incorporated by reference herein.

If you do not so agree to the foregoing, you should not click to affirm your acceptance thereof, in which case you are prohibited from accessing or using the Website. If you do not agree to any of the terms set forth in the Terms & Conditions, kindly discontinue viewing or participating in this Website immediately.
Agreement for the Users & Amendment:
All references to "you" or "your” mean and indicates the person/ visitor/ user that accesses, uses, and/or participates in the Website in any manner. If you use the Website or open an Account (as defined below) on behalf of a business, you represent and warrant that you have the authority to bind that business and your acceptance of the T&C will be deemed an acceptance by that business and "you" and "your" herein shall refer to that business.
This Agreement applies to all services offered on the Website and by TCPL/dialurban, collectively with any additional terms and conditions that may be applicable in respect of any specific service used or accessed by User(s) on the Website. In the event of any conflict or inconsistency between any provision of this Agreement and any additional terms and conditions applicable in respect of any service offered on the Web Site, such additional terms and conditions applicable in respect of that service shall prevail over this Agreement. This Agreement shall govern the User’s usage of TCPL/dialurban Services and, the User acknowledges that this Agreement shall supersede all or any term, agreement, contract executed between TCPL/dialurban and the User
Dialurban reserves the right, in its sole discretion, to change, modify, or otherwise amend the T&C / Privacy Policy, and any other documents incorporated by reference herein for complying with legal and regulatory framework and for other legitimate business purposes, at any time, and dialurban will post notice of the changes and the amended T&C at the domain of www.Dialurban.com. Your use of the Website following any modification & amendment of the T&C will signify your consent to and acceptance of any revised T&C. If you do not agree to abide by these or any future T&C, please do not use or access the Website.

Third Party Websites:
Websites / Sub-domain names assigned by TCPL/dialurban to User(s) (including both paid and free User(s)) are the exclusive property of TCPL/dialurban and it cannot be assumed to be permanent in any case. TCPL/dialurban reserves the right, without any prior notice, at any point of time, to suspend or terminate or restrict access to or edit any Website / Sub-domain names. In all such cases, TCPL/dialurban will not be liable to any party for any direct, indirect, special or other consequential damages, including, any lost profits, business interruption or otherwise.
TCPL/dialurban may allow User(s) access to content, products or services offered by third parties through hyperlinks to the websites offered by such third parties. TCPL/dialurban advises its User(s) to read the terms and conditions of use and/or privacy policies applicable in respect of such Third Party Websites prior to using or accessing such Third Party Websites. Users acknowledge and agree that TCPL/dialurban has no control over any content offered on Third Party Websites, does not monitor such Third Party Websites, and shall in no manner be deemed to be liable or responsible to any person for such Third Party Sites, or any content, products or services made available thereof.

Links to third party sites are provided on Web Site as a convenience to User(s). User(s) acknowledge and agree that TCPL/dialurban do not have any control over the content of such websites and/ or any information, resources or materials provided therein.

Intellectual Property Rights:
TCPL/ dialurban is the sole owner and the lawful licensee of all the rights to the Website and its content, which means the design, layout, text, information, images, graphics, sound, video etc. of or made available on the Website. The Content in the Website carry trade secrets and other intellectual property rights protected under worldwide copyright and other applicable laws pertaining to intellectual property. All title, ownership and intellectual property rights in the Website and its Content shall remain in TCPL/dialurban.

All rights, not otherwise claimed under this Agreement by TCPL/dialurban, are hereby reserved. Any information or advertisements contained on, distributed through, or linked, downloaded or accessed from any of the services contained on the Website or any offer displayed on or in connection with any service offered on the Website is intended, solely to provide general information for the personal use of the User(s), who fully accept any and all responsibility and liabilities arising from and out of the use of such Information. TCPL/ dialurban does not represent, warrant or endorse in any manner the accuracy or reliability of Information in the Website, or the quality of any products and/or services obtained by the User(s) as a result of any Information posted in the Website.
For any content and or link uploaded to the Website by the User from any third part website / platform, then the User agrees to abide and accepts, the terms of service of the said third party platform.

TCPL/dialurban reserve the right, in its sole discretion and without any obligation, to make improvements to, or correct any error or omissions in any portion of the Information in the Website.
Trademark - "Dialurban.com", “Triptales”, and related icons and logos are registered trademarks or trademarks or service marks of TCPL/dialurban in various jurisdictions and are protected under applicable copyright, trademark and other proprietary and intellectual property rights laws. The unauthorized adoption copying, modification, use or publication of these marks is strictly prohibited.
Copyright - All Content in the Website including all type of Information is copyrighted to TCPL/dialurban excluding any third-party content and any links to any third-party websites being made available or contained on the Web Site. User(s) may not use any trademark, service mark or logo of any independent third parties without prior written approval from such parties.
Services & Packages provided by TCPL/dialurban –
TCPL/dialurban provide the following services to its Customers:

Verified: is marked on the Users if any of their mobile and/or email is verified by TCPL/dialurban.

Premium: is marked on the Users after collecting and verifying all the required business related documents and information.

Online Platform, Registration, Eligibility Criteria and Accessibility –
Online Platform:
This Website acts as a mere online platform for User(s) to negotiate and interact with other User(s) for entering into negotiations in respect thereof for sale or supply of goods or services.
TCPL/dialurban are not parties to any negotiations that take place between the User(s) of the Website and are further not parties to any agreement including an agreement for sale or supply of goods or services or otherwise, concluded between the User(s) of the Website.
TCPL/dialurban provide an on-line platform to facilitate interaction between buyers and suppliers of products and services. TCPL/dialurban does not represent the seller or the buyer in transactions and does not charge any commission for enabling any transaction. TCPL/dialurban does not control and is not liable to or responsible for the quality, safety, lawfulness or availability of the products or services offered for sale on the Web Site or the ability of the suppliers to complete a sale or the ability of buyers to complete a purchase.
TCPL/dialurban does not control and is not liable in respect of or responsible for the quality, safety, genuineness, lawfulness or availability of the products or services offered for sale on the Website or the ability of the User(s) selling or supplying the goods or services to complete a sale or the ability of User(s) purchasing goods or services to complete a purchase. This agreement shall not be deemed to create any partnership, joint venture, or any other joint business relationship between TCPL/dialurban and any other party.
Eligibility Criteria:
Dialurban hereby grants you a non-exclusive, revocable license to use the Website as set forth in the T&C.
You represent, acknowledge and agree that you are at least 18 years of age and that all registration information that you submit are true and accurate.
Your use of the Website and Services/Products offered through this Website should not violate any applicable law.
User(s) represent and warrant that they have the right to avail or use the services / products provided by TCPL/dialurban, including but limited to the Website or any other services/products provided by TCPL/dialurban in relation to the use of the Website ("TCPL/dialurban Services"). TCPL/dialurban’s Services can only be availed by those individuals or business entities, including sole proprietorship firms, companies and partnerships, which are authorised under applicable law to form legally binding agreements.
Business entities or organisations that are not authorised by law to operate in India or other countries are not authorised to avail or use TCPL/dialurban’s Services.
Accessibility:
You will not copy, distribute, or make derivative works of the Website in any form or medium, nor alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purposes, without dialurban's prior written consent
Your Account may be terminated without notice if we believe that you are under the age of 18 or violating any clauses of this Terms & Conditions or that you are not complying with any applicable laws, rules or regulations.
You shall not contact, recruit or solicit in any Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, for employment or contracting for any business not associated with dialurban without express written permission from dialurban.
You shall not use any automated system, including but not limited to, "robots," "spiders," "scrapers," etc., to access the Website for any purpose without dialurban's prior written approval.
Registration:
To create an account, you must submit the required information through the registration page on the Website and create a password. You may also register for an Account using your existing Facebook account and log-in credentials.
You shall not in any manual or automated manner collect information of Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers,, including but not limited to, names, addresses, phone numbers, or email addresses, copying copyrighted text, or otherwise misuse Website information or content.
You are solely responsible for safeguarding your dialurban password and shall keep your Passwords secure at all times. You shall be solely responsible for all activity that occurs on your Account and you shall notify dialurban immediately of any breach of security or any unauthorized use of your Account. Similarly, you shall never use another's Account without dialurban’s permission.
You hereby expressly acknowledge and agree that you yourself and not dialurban will be liable for your losses, damages etc. (whether direct or indirect) caused by an unauthorized use/ misuse of your Account. Notwithstanding the foregoing, you may be liable for the losses of dialurban or others due to such unauthorized use.
User(s) agree that by registering on the Website, they consent to the inclusion of their personal data in TCPL/dialurban’s on-line database and authorize TCPL/dialurban to share such information with other User(s). TCPL/dialurban may refuse registration and deny the membership and associated User ID and Password to any User(s) for whatever reason. TCPL/dialurban may suspend or terminate a registered membership at any time without any prior notification in interest of TCPL/dialurban or general interest of its User(s) without assigning any reason thereof and there shall arise no further liability on TCPL/dialurban of whatsoever nature due to the suspension or termination of the User account. User(s) registered on the Website are in no manner a part of or affiliated to TCPL/dialurban.

User(s) further agree and consent to be contacted by TCPL/dialurban through phone calls, SMS notifications or any other means of communication, in respect to the services provided by TCPL/dialurban even if contact number(s) provided to TCPL/dialurban upon registration are on Do Not Call Registry.
You shall be solely responsible for any financial transaction initiated using this website like credit card/ debit card /UPI payments/ any other Online payments; and in no ways dialurban will be liable for any such loss; however will try to support in all possible ways.
Account / Subscription/ Membership Termination:
If TCPL/dialurban terminates the membership of any registered User(s) including those User(s) who have subscribed for the paid services of TCPL/dialurban, such person will not have the right to re-enroll or join the Website under a new account or name unless invited to do so in writing by TCPL/dialurban. In any case of termination, no subscription / membership fee/charges paid by the User(s) will be refunded.
TCPL/dialurban reserves the right to terminate the membership/subscription of any User(s) temporarily or permanently for any of the following reasons:
Providing false information in connection with their account registered with TCPL/dialurban and/ or if such User(s) are engaged in fraudulent or illegal activities / transactions, or, If such User(s) posts any material that is not related to trade or business cooperation, or, If such User(s) breaches any provisions of the Agreement, or,

If such User(s) is involved in unauthorized access, use, modification, or control of the Website database, network or related services, or, If such User(s) utilizes the Website to send spam messages or automatic publish the same product information, Or any other User(s) activity that may not be in accordance with the ethics and honest business practices, and are termed as illegal.
TCPL/dialurban reserve the right to terminate access to certain areas or features of the Website at any time without assigning any reason and with or without notice to such User(s). TCPL/dialurban also reserves the right to deny access to particular User(s) to any or all of its services or content without any prior notice or explanation in order to protect the interests of TCPL/dialurban and/ or other User(s) of the Website. TCPL/dialurban to change any or all of the features of the Website or introduce new features without any prior notice to User(s).
Code of Conduct for Registered User –
You shall not upload, post, transfer, disseminate, distribute, or facilitate distribution of any content, including text, data, images, video, sound, information, or software, code, to any part of the Website, including your profile, the posting of your Service, or the posting of any opinions or reviews with the Website (Referred as “Code of Conduct”)
Such Code of Conduct or Act:

must not invade anyone's privacy by attempting to harvest, collect, store, or publish private or personally identifiable information, such as names, email addresses, phone numbers, home addresses, passwords, account information, credit card numbers, or other contact information without their knowledge and willing consent;
must not contain falsehoods or misrepresentations that could damage dialurban or any third party;
should not be copyrighted, protected by trade secret or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from the lawful owner to post the material and to grant dialurban all of the license rights granted herein;
should not contain elements of harassing, hateful, pornographic, illegal, obscene, libelous, slanderous, defamatory threatening, discriminatory, racially, culturally or ethnically offensive; incites, advocates, or expresses pornography, obscenity, vulgarity, profanity, hatred, racism, or gratuitous violence;
should not contain or promote an illegal or unauthorized copy of another person's copyrighted work, such as pirated computer programs or links to them, pirated music or links to pirated music files, or lyrics, guitar tabs or sheet music, works of art, teaching tools, or any other item the copy, display, use, performance, or distribution of which infringes on another's copyright, intellectual property right, or any other proprietary right;
should not be intended to threaten, stalk, defame, degrade, victimize, or intimidate an individual or group of individuals for any reason on the basis of age, gender, ethnicity, sexual orientation, race, disability or religion;

should not advertise or solicit a business not related to or appropriate for the Website (as determined by dialurban in its sole discretion); further more should not advertise directly or indirectly any form of ponzi schemes, discount cards, online surveys or online contests;
should not distribute or contain viruses or any other technologies that may harm dialurban server, or the property of dialurban users;
should not contain identical content to other open Postings you have already posted and should not use any form of automated device or computer program that enables the submission of Postings;
should not encourage conduct that would be considered a criminal offense or violate any law;
should not post any message with direct or indirect intension of cheating or making fraud attempts by providing financial offers;

Dialurban has the right, in its sole discretion and without prior notice to you; to immediately remove any posting that discriminates or is any way in violation of any law or dialurban’s Terms & Conditions.
You should not post any Postings which are prohibited under Indian laws of any preference, limitation or discrimination based on age, race, color, religion, sex, creed, national origin, disability or other protected class. dialurban will not knowingly accept any Posting which is in violation of the law.
You must not fail to deliver payment for Services purchased by you, unless the Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, has materially changed the Service description after you negotiate an agreement for such Service or you cannot authenticate the identity of Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers,.
As a participant in the Website, you agree to use careful, prudent, and good judgment when leaving Feedback for another user. In case of inappropriate Use of Feedback or violation of any of the rules in connection with leaving Feedback, dialurban, in its sole discretion, may cancel your Feedback or any of your Postings, limit your Account privileges, de-activate your Account. You may contact info@Dialurban.com, in case of inappropriate feedback.
Terms of Use for all User(s) – (Manufacturers / Suppliers / Users/ Customers)

Must not commit to purchase or use a Service without paying.
Must not agree to purchase a Service when you do not meet the Service Professional's terms as outlined in the Posting.
Must not agree to purchase a Service with the intention of disrupting a Posting
Must not misuse any options made available now or in the future by dialurban in connection with the use or purchase of any Service.

Must not misrepresent the location at which they will provide a Service.
Must not list Services or Offers related to any Service in an inappropriate category.
Must not include any information in their Profile that is fraudulent.
Must not exceed multiple Posting limits.
Must not use misleading titles that do not accurately describe the Service.
Must not offer the opportunity through dialurban to purchase the Service or Product or any other service outside of dialurban.
If we realize that any professional is involved illegal or wrong doings and not adhering to dialurban’s Terms & Conditions, then dialurban holds the sole discretion to blacklist the Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, and withhold any outstanding credits or payments to the professional.
Must not promote services not offered on the Website and/or any prohibited services.
Shall not solicit Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, to send cash or use any other payment methods not specifically permitted by dialurban as approved payment methods.
If a Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, violates any of the above rules or any terms of this agreement in connection with his or her Posting, dialurban, in its sole discretion, may; cancel the Posting, de activate the Account of Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers,, forfeit any fees earned on a cancelled Posting, limit the Account privileges of Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, and decrease the popularity earned by Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, through the Feedback page.

Dispute among Users and between dialurban/TCPL:
All notices to TCPL/dialurban shall be valid and effective if it is in writing form and shall be deemed to be duly made when sent to TCPL/dialurban corporate address mentioned in the website.

All notices to or upon a User(s) shall be valid and effective if either delivered personally, sent by courier, postal mail, by facsimile or email (for FAX and Email only those address provided by the User(s) on the Web Site), or by posting such notice on a space of the Website that is publicly accessible without a charge.

Notice to a User(s) shall be deemed to be received by such User(s) if and when Website is able to demonstrate that communication, whether in physical or electronic form, has been sent to such User(s)
Awareness & Acceptance of Risks by Users:
User(s) agree to fully assume the risks of any transactions conducted on the basis of any content, information or any other material provided on the Website and further assume the risks of any liability or harm of any kind arising due to or caused in connection with any subsequent activity relating to any products or services that are the subject of any such transaction.

Such risks include, but are not limited to, misrepresentation of products and services, fraudulent schemes, unsatisfactory quality, failure to meet specifications, defective or dangerous products, unlawful products, delay or default in delivery or payment, cost miscalculations, breach of warranty, breach of contract and transportation accidents.
Such risks also include the risks that the manufacture, import, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Website may violate or may be asserted to violate Third Party Rights, and the risk that that User(s) may incur costs of defense or other costs in connection with third parties' assertion of Third Party Rights, or in connection with any claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by Third Party Rights claimants.
Such risks further include the risks that r the purchasers, end-users of products or others claiming to have suffered injuries or harms relating to product originally obtained by User(s) of the Website as a result of purchase and sale transactions in connection with using any content, information or any other material provided on the Web Site may suffer harms and/or assert claims arising from their use of such products.

User(s) agree that TCPL/dialurban shall not be liable or responsible for any damages, liabilities, costs, harms, inconveniences, business disruptions or expenditures of any kind that may occur/arise as a result of or in connection with any Risks during any transaction. User(s) are solely responsible for all of the terms and conditions of the transactions conducted on, through or as a result of use of any content, information or any other material provided on the Website , including, without limitation, terms regarding payment, returns, warranties, shipping, insurance, fees, taxes, title, licenses, fines, permits, handling, transportation and storage. In the event of a dispute with any party to a transaction, User(s) agrees to release and indemnify TCPL /Dialurban (and our agents, associates, directors, officers and employees) from all claims, demands, actions, proceedings, costs, expenses and damages (including without limitation any actual, special, incidental or consequential damages) arising out of or in connection with such transaction.

Terms of Use for Content & Information provided for the website –
You agree that any content/information provided by you for which you authorize to be searchable by Registered Users who have access to the Website is provided on a non-proprietary and non confidential basis.
You understand that whether or not such content is published, i.e. submission of videos or other communications submitted by you and other users, including without limitation, your Profile, your Offer, your Wants, any Feedback, dialurban does not guarantee any confidentiality with respect to any content.
You may remove your content from the Website at any time. If you choose to remove your content, the license granted above will automatically expire.
You shall be solely responsible for your own content and the consequences of posting or publishing it. In connection with content provided by you, you affirm, represent, and/or warrant that, you own or have the necessary licenses, rights and permissions to use, and grant or authorize dialurban to use all patent, trademark, copyright or other proprietary rights in and to any and all contents provided, on a non-exclusive, royalty-free mode.
You agree, acknowledge and understand that when using the Website, you will be exposed to content (photos, profiles and other content) from various sources, and that dialurban is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such content.
You can send any suggestions related to dialurban, to info@dialurban.com. All such Suggestions are, and will be treated as, non-confidential and non-proprietary. You hereby assign all right, and dialurban is free to use, without any attribution or compensation to you, any ideas, know-how, concepts, techniques, or other intellectual property and proprietary rights contained in the Suggestions, whether or not patentable.
Modifications or Termination of Website –
Dialurban reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Website (or any part thereof) with or without notice and in its sole discretion. You agree that dialurban shall not be liable to you or to any third party for any modification, suspension or discontinuance of dialurban services.
You hereby agree that dialurban, in its sole and absolute discretion, has the right to delete, terminate, or deactivate your Account, block your email or IP address, cancel the Website or otherwise terminate your access to or participation in the use of the Website (or any part thereof), or remove and discard any content on the Website, immediately and without notice, for any reason, including without limitation, account inactivity or if dialurban believes or has reason to believe that you have violated any clause of the T&C.
You may cancel or terminate your use of the Website and its T&C with or without cause at any time by following the process mentioned in the website.
Fees, Payments and Refunds –
Registering dialurban, opening an Account, posting Services and viewing posted Services is free. dialurban reserves the right at its sole discretion to charge fees to Service Professionals for certain services.
Dialurban may also in certain categories require Service/Product Professionals, Manufacturers / Suppliers, to make payments for following up on leads i.e. requests posted by User/Customers, and permitting the Service/Product Professionals, Manufacturers / Suppliers to contact the User/Customer through a fees against the leads, irrespective of whether the job leads eventually result in a transaction or exchange of consideration/information for the service requested. In order to be eligible to make such payment for Leads, Service/Product Professionals, Manufacturers / Suppliers / Users, shall be required to make advance payments from which the Lead - Fee may be deducted as and when necessary. Whenever the Credits fall below the prescribed threshold, the Service/Product Professionals, Manufacturers / Suppliers / Users, shall be prompted to refill the wallet in order to continue enjoying the ability to follow up on leads and contacting Service Users.
The Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, is entitled to refund that is credited back in their wallet in the following terms & conditions:

Refunds are processed only when a customer has cancelled the request and not viewed your profile
Refunds are processed in the event; of a provided lead is identified to be non-genuine
Refunds are processed if the customer has not viewed quote and not cancelled request 5 days after your response
If the Service User within 48 hours of posting a request on the Website withdraws the same by way of the Website or the mobile application.
If the Service User does not open or access the response of Service/Product Professionals, Manufacturers / Suppliers / Users, the Lead Fee shall be reimbursed to the Service Professional.
Dialurban offers Packaged services to Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, for a fee and may in the future offer additional services. dialurban reserves the right to charge fees for these services at its sole discretion.

Fees by manufacturer / supplier / service provider: Joining dialurban, opening an Account, viewing posted Services, and bidding on posted Services is free. dialurban currently does not charge Service Users/Customers for transactions completed on the Website between Service Users/Customers and Service/Product Professionals, Manufacturers / Suppliers / Users. However, dialurban reserves the right to charge a fee to Service Users/Customers in the future on a per-transaction basis or in any other manner, and reserves the right to do so in its sole discretion. New changes to this Fee Policy are effective after a 30 days’ notice by dialurban in the website.
All manufacturer/supplier/service providers who wants to do listing or displays its products/services shall register and subscribe in dialurban website at a cost based on the package selected. For providing each call/lead, a certain declared amount shall be deducted from the wallet of the manufacturer / supplier / service provider. In this way dialurban enhance the business of manufacturer / supplier / service provider and provide services to users/customers
You agree to pay all fees or charges to your Account based on dialurban's fees, charges, and billing terms which is current and effective. If you do not pay on time, dialurban reserves the right to either suspend or terminate your access to the Website and Account. You are expressly agreeing that dialurban is permitted to bill you for the applicable fees, any applicable tax and any other charges you may incur in connection with your use of this Website and the fees will be billed to your credit card, a payment gateway or other payment method designated at the time you make a purchase or register for a fee-based service.
If you cancel your Account at any time, you will not receive any refund. If you have a balance due on any account, you agree that dialurban may charge such unpaid fees to your credit card or otherwise bill you for such unpaid fees. dialurban reserves its right to initiate appropriate legal proceedings, if necessary, in its sole discretion, to recover such outstanding amounts.
Refunds: All commissions payable to dialurban by Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, on various transactions, are final and non-refundable.
All money paid by Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, in form of “Credits points to Wallet” shall be refunded to the Service Professionals if they remain un-utilised for a period greater than 364 days only. Such amounts shall not be refunded prior to that.
In case of poor customer service or inappropriate behaviour with customers, then the Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, shall be de-listed from the dialurban associate platform, then all wallet credits will be forfeited, and there will be no refund made in such a cases.
Taxes applicable: You understand that we are acting solely as an intermediary for the collection of rents and fees between a Service User and a Service Professional who choose to enter into an Agreement for Service. Because state and local tax laws vary significantly by locality, you understand and agree that you are solely responsible for determining your own tax reporting requirements in consultation with tax advisors, and that we cannot and do not offer tax advice to either hosts or guests. Further, you understand that dialurban shall not be responsible or liable in any manner in relation to tax liability of a Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers.
Other Terms for Clarity –
Each Registered User hereby acknowledges and agrees that dialurban is NOT a party to any oral or written Agreement for Service, or any contract entered into between Registered Users in connection with any Service offered, directly or indirectly, through the Website. Each Registered User acknowledges, agrees and understands that dialurban only seeks to provide a platform wherein the Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, can be brought together.
No agency, partnership, joint venture, or employment is created as a result of the T&C or your use of any part of the Website. You do not have any authority whatsoever to bind dialurban in any respect. All Service/Product Professionals, Manufacturers / Suppliers / Users/ Customers, are independent contractors. Neither dialurban nor any users of the Website may direct or control the day-to-day activities of the other, or create or assume any obligation on behalf of the other.
Subject to the provisions regarding disputes between Website participants in connection with Feedback, your interactions with individuals and/or organizations found on or through the Website, including payment of and performance of any Service, and any other terms, conditions, warranties or representations associated with such transactions or dealings, are solely between you and such individual or organization.
If a dispute arises between you and dialurban, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and dialurban hereby agree that we will resolve any claim or controversy at law and equity that arises out of the T&C or the Website. The dispute shall be resolved through various alternative dispute resolution procedures, such as mediation or arbitration, etc.
Disclaimer of Warranties & Limited Liabilities –
User(s) acknowledge that inability to use the Website wholly or partially for whatever reason may have adverse effect on their business. User(s) hereby agree that in no event shall TCPL/dialurban be liable to any User(s) or any third parties for any inability to use the Website (whether due to disruption, limited access, changes to or termination of any features on the Website or otherwise), any delays, errors or omissions with respect to any communication or transmission, or any damage (direct, indirect, consequential or otherwise) arising from the use of or inability to use the Website or any of its features.

It only advertises and/or showcases the pharmaceutical products posted by Users(s). Accordingly, the User posting the content shall ensure that the content so posted does not violate any statue in the rules made thereunder including the Act(s) as referred above, so that no consequences of any nature could be attributed to TCPL/dialurban in any manner whatsoever.

Users(s) hereby undertake that they shall solely be responsible and shall bear all the liabilities in respect of selling prescription medicines and/or drugs mentioned in any of the Schedules of the Drug Rules without a prescription issued by a registered medical practitioner and in accordance with the conditions laid down in such rules. In the event of breach of such condition, TCPL/dialurban shall not be liable and responsible in any manner whatsoever.

TCPL/dialurban does not offer any guarantees or warranties on the medicinal / pharmaceutical products or services displayed or listed on the Website (if any) and is not liable for any relevant transaction between the User(s), including transactions involving sale of any medicine(s) restricted and/or banned for sale by any governmental or any other regulatory authorities.
